Attendance and participation at the City of La Verne Council meetings are welcomed and
appreciated. Community engagement provides the City Council with valuable information. Regular
Meetings are held on the 1st and 3rd Monday of every month. In compliance with the American
Disabilities Act, any person with a disability who requires a modification or accommodation in order to

c. Resolution (s) passage and adoption recommended, as follows:
1. Resolution 17-72 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LA VERNE, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, AUTHORIZING A
PROFESSIONAL SERVICE AGREEMENT WITH MISTY CHENG AND ASSOCIATES -
Due to the recent retirement of the City’s Finance Director, it is necessary for the
City to execute a contract with the financial services firm Misty Cheng & Associates
to provide the necessary staffing support to assist with the day to day oversight
and management of the finance department.
It is recommended that the City Council approve Resolution No. 17-72, executing a
professional service agreement with Misty Cheng and Associates and authorize the
City Manager to sign said agreement.
2. RESOLUTION NO. 17-73 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LA VERNE, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA AMENDING THE
2017-18 BUDGET TO INCORPORATE PROJECTS FUNDED BY SB 1: THE ROAD
REPAIR AND ACCOUNTABILITY ACT AND TO ADJUST THE APPROPRIATION
LIMITS - On April 28, 2017, Governor Brown signed into law Senate Bill 1 (SB 1),
also referred to as the Road Repair and Accountability Act (RRAA) of 2017. SB 1
provides for increased gas taxes and registration fees, which are to be deposited
into the State’s newly created Road Maintenance and Rehabilitation Account
(RMRA). RMRA funds will be apportioned to local agencies each year for basic
road maintenance, rehabilitation, and other safety projects. SB 1 also requires
each eligible agency to submit a project listing to the California Transportation
Commission (CTC) in order to receive these funds. La Verne’s allocation for fiscal
year 2017/18 is estimated at $187,583.
Staff recommends that the City Council approve Resolution No. 17-73, approving
the SB1 project list and amending the current fiscal year budget to reflect an
estimated revenue of SB1 funds in the amount of $187,583 and to appropriate said
funds for use towards the reconstruction of E Street in Spring 2018. Staff further
recommends appropriation of $454,000 in Surface Transportation Program - Local
funds, which were originally programmed for this project in fiscal year 2016/17.

Ordinance No. 1077 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
LA VERNE, CALIFORNIA DELETING CHAPTER 18.82 OF THE LA VERNE MUNCIPAL
CODE IN ITS ENTIRETY AND ADDING A NEW CHAPTER 18.82 RELATING TO MEDICAL
AND ADULT USE OF CANNABIS AND ADOPTING A PROHIBITION OF ALL COMMERCIAL
CANNABIS ACTIVITIES IN THE CITY AND IMPOSING REGULATIONS FOR PERSONAL
CULTIVATION OF CANNABIS - On September 5, 2017, City Council placed on first
reading Ordinance No. 1077, which would delete and readopt Chapter 18.82 of the
La Verne Municipal Code relating to personal cultivation of marijuana and all
commercial marijuana activities. The Ordinance was scheduled for second reading on
September 18, 2017, although, the item was pulled from the agenda due to
changes in State law. The Ordinance was since amended to account for the
Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA). The
MAUCRSA was signed by the California Governor on June 27, 2017 and repealed the
previous provisions of law relating to medical cannabis, including certain provisions
of the Adult Use of Marijuana Act. The revised Ordinance makes no amendments to
the land use provisions contained in the previous Ordinance. The revision contains
references to the newly adopted law to ensure the City of La Verne regulations
regarding marijuana are consistent with State law. Development Review Committee
and staff recommend approval of Ordinance No. 1077. City Council at its Meeting of
October 2, 2017, placed on first reading Ordinance No. 1077.
Staff recommends City Council approve Ordinance No. 1077, deleting Chapter 18.82 of
the La Verne Municipal Code and adding new Chapter 18-82 relating to medical and
adult use of cannabis and adopting a prohibition of all commercial cultivation of
cannabis.
5. OTHER MATTERS
Economic Assistance Agreement with Chase’s Restaurant - Chase’s Restaurant originally
opened in 2010. Since that time, it has grown in popularity and has become a key part of the
restaurant sales growth the Old Town area has experienced in the last 6 years. Recently, staff
has become aware that the owners are interested in expanding and moving to another location in
Old Town. As part of that expansion, they are seeking City assistance with costs associated with
that move and expansion. The following agreement would allow the City to provide a loan to
facilitate their move with a formula for reimbursement on a sliding scale based on the increases
of revenue from sales tax.
Staff Recommendation: The City Council should approve Resolution 17-74, executing
an Economic Assistance agreement with Chase’s Restaurant,
LLC and authorize the City Manager to sign said agreement.
