AN ACT
“To amend Chapter 1 of ‘Title 35 of the Olficial Code of Georgia Annotated, relating to
_gencral provisions regarding law enforcement officers and aget
cies, £0 as to prokubit law
enforcement [kom relaining license platc dala obtaincd from automated license plate
recognition systems heyond a certam period; to provide for definitions: ta provide for the
‘exchange or sharing of data obtained from license platc rcengnition systems by law
enforcement; t provide for criminal penalties for misuse of captured license plate data; to
provide for policies; tp provide for rclated matters; to repcal conflicting laws; and for other
purposes
DE If ENACTLD BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
Chapter 1 of Title 35 of the Official Code of Georgia Annotated, gelating to general
provisions regarding law enforcement officers and agencies, is amended by adding » new
Code section to ead as flows:
fs) As uted jn this Code section, the term:
1) Automated license plate ecomnition sysem' meuns ore or more high-speed eameras
combined with computer algorithms used tn convert images of Siconse. plates. into
somputer readable data
2) ‘Captured licgnse plale dats means the plobal positioning deviee coordinates, date
and time, photograph, license plate number, and any other data captured by or detived
from an automated license place recognition sysiem or any other source,

27 (4) ‘Law enforeement purpose! mcans the investigation of an offense of activity initiated,
2 bya low enforcement ageney.
29 (5) ‘Porson’ means an individual, corporation, compar, partaership, fiom, association,
30 joint venture, or any other uninevrporsted association ur group.
31 Law enforcement a yeatlect license plate data, Such data shall he
32 ipted immediately upon collectionand not accessed excep? fora law enforcement purpose
33 Allsuch data collected shall be destroyed no Iater than 30 months after such data were
34 originally eollccicd unless such data ae the subject mater af a talf violation or fora law
35 cuforsement purpose
36 (c)_Law enforcement agencies may exchange ar share captured license plate dats with
37 other law enforcement apencies lor lw enforcement purposes
38 (@NLL) Any person who knowingly requests, uses, obtains. of allemprs to obtain captured
39 license plate data of a Inw onforcement agency under falke pretenses or for any purpose
40 other than fora las: enforcement purpose shall for euch such offense, upon conviction
41 thereof, be guilty of a misdemeanor of a high and aggravated
42 (2) Nothing inthis Code section shall be construcd to proclude a law enforeenscnl weeny
43 ftom contracting with « person ta hold and maintain captured ifconse plate data for such
44 law enforcement anenev: provided, however, that such person shall be subivel to the
45° polities of the law enforcement agency andl naraeryph (1) of this subsectio
